Why US scope has to be assessed state by state

Most vendors describe themselves as "CCPA compliant" and stop there. That is not a scope assessment, and it is not sufficient for a data protection review at a serious US company.

The US has no single federal privacy statute covering commercial data collection. Instead there is a growing patchwork of state acts — California, Virginia, Colorado, Connecticut, Utah and more since — with meaningfully different definitions, thresholds and consumer rights. Sector regimes sit on top: HIPAA for health information, GLBA for financial data, and state-level insurance and lending rules.

What this means practically for a scope document

  • Which states' residents could be involved. Consumer-facing sources touching identifiable people need per-state assessment, not a blanket claim.
  • Whether any sector regime applies. Healthcare and financial sources bring their own rules regardless of state.
  • What our exclusions remove. We do not collect patient data, we do not resell personal data, and B2B contact data requires documented lawful basis. In practice these exclusions remove most of the state-law exposure before it arises.
  • Deletion and rights handling. Where any personal data is in scope, suppression and deletion processes are documented rather than assumed.

Our written methodology document names the sources, the fields, the exclusions and the basis, per engagement. Your counsel then assesses against the states that matter to you. We are not your lawyers and will not pretend the assessment is ours to make — but we will give them something real to assess.

What US teams most often get wrong when buying data collection
